Compromis 620

France, with its state-owned EDF, sells nuclear power far below marginal cost. Without a guarantee for Engie (a private, partially French-owned company), Belgium would have been at the mercy of French export prices. The Compromis 620 ensures that Belgian nuclear remains dispatchable even when French prices dip artificially low due to state subsidies.

Germany initiated proceedings against Poland before the PCIJ. While the case had earlier phases (notably the 1926 judgment on the merits finding Poland in breach), the phase associated with dealt specifically with the consequences of that breach. The Court had to determine the form and amount of indemnity due to Germany. compromis 620

One former MEP aide (speaking on condition of anonymity) told me: “Compromis 620 was real. It was an eleventh-hour compromise on data residency. But it was never published because three member states threatened to walk unless the language was stripped entirely—and then they demanded the original draft be deleted, not just revised.” Germany initiated proceedings against Poland before the PCIJ
