Before 2005, heritage protection in Malaysia was somewhat fragmented, governed partly by the Antiquities Act 1976 and various local by-laws. The National Heritage Act 2005 repealed the Antiquities Act, consolidating the management of heritage under a single, more robust statute. It marked a paradigm shift from merely protecting "old objects" to managing "living heritage" and intangible cultural practices.
The Act mandates the creation of a Register of National Heritage. Any item, site, or person (living human treasure) deemed to have "outstanding value" to the nation can be listed. Once listed, these items cannot be exported, altered, or destroyed without specific approval from the Commissioner of Heritage.
